These Terms of Service ("Terms") form a binding agreement between you and the independent operator of WebScan Pro ("we", "us", "our") and govern your access to and use of the WebScan Pro desktop application, website, account service and related services (together, the "Service"). By creating an account, downloading, or using the Service, you confirm that you have read, understood and agree to be bound by these Terms and by our Acceptable Use Policy and Privacy Policy, which are incorporated by reference. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old, or the age of majority where you live, and legally able to enter into a contract. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms, and "you" refers to that organization.

2. Authorized use only

WebScan Pro is a professional security-testing tool intended solely for lawful, authorized testing. You may only scan, probe or test systems that you own or for which you hold explicit, current, written authorization from the lawful owner, and only within the scope of that authorization. You are solely responsible for obtaining and holding such authorization. The Service requires you to affirmatively acknowledge authorization before each scan; that acknowledgement is your representation and warranty that it is true. Unauthorized scanning may be unlawful and is strictly prohibited. Full rules are in our Acceptable Use Policy.

3. Accounts & security

To use certain features you must create an account. You agree to provide accurate information, keep your password confidential, and remain responsible for all activity under your account. Notify us promptly at support@webscanpro.app if you suspect unauthorized use. We may refuse, suspend or reclaim any account at our reasonable discretion, including for suspected abuse.

4. How the Service works (local execution)

Scans run locally on your own device. We do not receive, process, or store your scan targets, requests, payloads, credentials or results. Our cloud service only issues your account identity and plan entitlements, and enforces plan limits. You are responsible for your device, network, and the systems you choose to test.

5. Licence & restrictions

We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to install and use the Service in accordance with these Terms and your plan. You may not: (a) copy, resell, sublicense, rent or redistribute the Service; (b) reverse engineer, decompile or attempt to extract source code except to the extent this restriction is prohibited by applicable law; (c) remove or alter any proprietary notices; (d) use the Service to build a competing product; or (e) use the Service in violation of these Terms, the Acceptable Use Policy, or any law.

6. Plans, billing & cancellation

The Service offers a free plan and paid subscription plans (currently Pro and Team). Paid plans are billed on a recurring monthly basis through Paddle, which acts as our Merchant of Record and processes payments and applicable sales tax/VAT. By subscribing you also agree to Paddle's terms as the seller of record.

  • Renewal. Subscriptions renew automatically each billing period until cancelled.
  • Cancellation. You may cancel at any time; paid features remain available until the end of the current paid period, after which the account reverts to the free plan.
  • Refunds. Refunds are handled as described in our Refund Policy.
  • Price changes. We may change pricing or plan features; changes to your recurring price will be communicated before they take effect and apply from your next renewal.
  • Limits. Plans include usage limits (such as scans per day). We may enforce these limits technically.

7. Acceptable use

Your use of the Service must comply with our Acceptable Use Policy, which prohibits, among other things, unauthorized scanning, attacking or disrupting systems, and any unlawful activity. Violation is a material breach of these Terms and may result in immediate suspension or termination.

8. Intellectual property

The Service, including all software, text, graphics, the WebScan Pro name and logo, and all related content, is owned by us or our licensors and is protected by intellectual-property laws. Except for the licence granted above, no rights are transferred to you. Feedback you choose to send us may be used without restriction or obligation to you.

9. Third-party services

The Service integrates third-party providers, including Paddle (payments), a cloud hosting/CDN and email provider, and an AI provider used to generate optional report summaries. Your use of those features may be subject to the third party's own terms, and we are not responsible for third-party services.

10. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Security testing is inherently imperfect: results may contain false positives, miss real issues, or be incomplete. We do not warrant that the Service will detect all vulnerabilities, be uninterrupted or error-free, or that any finding is accurate. You are solely responsible for validating findings and for the security of your systems.

11. Your responsibility & indemnification

You are solely responsible for your use of the Service and for ensuring you are authorized to test every target. To the maximum extent permitted by law, you agree to defend, indemnify and hold us harmless from and against any claims, demands, liabilities, damages, losses, fines, penalties, costs and expenses (including reasonable legal fees) arising out of or related to (a) your use or misuse of the Service, (b) any scanning or testing you conduct without proper authorization, (c) your breach of these Terms, the Acceptable Use Policy, or any law, or (d) your violation of any third-party right.

12. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of data, profits, revenue, goodwill or business, arising out of or related to the Service or these Terms, even if advised of the possibility. To the maximum extent permitted by law, our total aggregate liability for all claims relating to the Service is limited to the greater of (a) the total amount you paid us for the Service in the twelve (12) months before the event giving rise to the claim, or (b) USD 50. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you; nothing here limits liability that cannot be limited by law.

13. Suspension & termination

We may suspend or terminate your access at any time, with or without notice, if you breach these Terms or the Acceptable Use Policy, engage in unauthorized or unlawful use, or where we reasonably believe it is necessary to protect the Service or others. You may stop using the Service and close your account at any time. Sections that by their nature should survive termination (including licence restrictions, disclaimers, indemnification, limitation of liability, and governing law) will survive.

14. Changes to the Service and Terms

We may modify or discontinue the Service, or any part of it, at any time. We may also update these Terms from time to time; the "Last updated" date will change and, for material changes, we will take reasonable steps to notify you. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

15. Governing law & disputes

These Terms are governed by the laws applicable at the operator's place of residence, without regard to conflict-of-laws rules. You agree that the courts there have jurisdiction over any dispute, except that nothing in these Terms deprives you of the protection of any mandatory consumer-protection law of your own country of residence, or of your right to bring proceedings there where such law provides. We encourage you to contact us first at support@webscanpro.app to resolve any dispute informally.

16. General

These Terms, together with the Acceptable Use Policy and Privacy Policy, are the entire agreement between you and us regarding the Service and supersede any prior agreements. If any provision is held unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a transfer of the Service. Headings are for convenience only.
